We are seeking a strategic business-savvy senior IP litigation counsel, who has familiarity with both administrative and judicial actions globally; familiarity with European and U.S. disputes required. This individual will have responsibility for facilitating intellectual property matters important for BioNTech\'s success through counseling senior business leaders and scientists, managing IP disputes, contributing to patent portfolio strategy and management, managing outside counsel\'s services and budgets, participating in IP competitive intelligence activities, and supporting company due diligence initiatives. The candidate will have a significant depth of experience in a wide range of intellectual property matters, and high technical competency in the life sciences. The candidate should also be acknowledged as a trusted advisor among business and research colleagues, be able to demonstrate a keen capacity to facilitate relationships with company colleagues and a multiplicity of business partners, evidence a capability to manage adversarial disputes positively and constructively. Furthermore, the candidate should also demonstrate a facility in formulating all-encompassing strategies to address actual or potential disputes, including pre-litigation strategies and case management. In addition, the candidate should have the ability to integrate intuitiveness and sensitivity into their approach to relationships, their work, and business. This position may be based in Mainz, Germany or Cambridge, Massachusetts, and will report directly to the lead of IP Litigation team.
Qualified European attorney, and/or US attorney (JD), with at least 10 years of relevant IP experience in the biotech/pharmaceutical industry, including significant firm and in-house experience. Advanced degree in a relevant biological science preferred.
Manage and support IP disputes, litigations, oppositions, IPRs and PGRs, and including formulating appropriate IP litigation strategies, particularly regarding filing, deposition, data collection procedures and confidentiality considerations.
Develop a thorough understanding of BioNTech\'s current and planned business activities, programs, competitors, and markets and keep abreast of developing legal trends, laws and regulations; particularly to protect BioNTech\'s IP and obviate potential adversarial actions.
Educate and advise senior management & scientists on important IP issues and advance IP/patent awareness, particularly regarding IP litigation.
Manage outside counsel and corresponding budget regarding IP litigation related activities.
Contribute to and maintain positive relationships with strategic external relationship counterparts.
Work with R&D Project, Commercial and Business Development teams and establish positive relationships with the teams regarding a variety of IP litigation related issues, regarding BioNTech in-licensed and solely owned IP, to protect and enhance the value and utility of BioNTech IP assets.
Provide high level, independent support for due diligence, strategic collaborations, licensing agreements and other business contracting needs.
Minimum requirements: Exceptionally strong communicator, particularly regarding complex information to senior management; supportive interpersonal team player; and demonstrated capability of analytical and strategic problem solving. Must have familiarity with all aspects of intellectual property law including drafting applications, prosecuting applications, supporting due diligence initiatives, and managing IP.
Practical problem solver with ability to make data informed decisions, confidence in making difficult decisions independently, and demonstrated capabilities in establishing business practices to manage legal and other risks.
Preffered requirements: Registration with the USPTO,direct experience with biologic patents and managing products through development, marketing approval and post-approval.
