Description

Supervises and is responsible for a program concerned with the enforcement and compliance of a wide variety of zoning regulations, including state laws and administrative rules, county codes, administrative rules and policies; establishes zoning code inspection requirements and procedures; handles matters involving land use; and performs other related duties as required.

Distinguishing Characteristics:

This class differs from that of Zoning Inspector III in that the Supervising Zoning Inspector supervises and is responsible for the zoning enforcement program of the County of Maui; whereas the Zoning Inspector III supervises and participates in the full range of enforcement activities relative to all types of commercial and residential buildings for compliance with zoning laws, ordinances, rules and regulations governing proper land use, buildings and outdoor signs.

Examples of Duties

The following are examples of duties and are not necessarily descriptive of any one position in this class. The omission of specific duties statements does not preclude management from assigning such duties if such duties are a logical assignment for the position and are consistent with the class concept.

  • Oversees the County of Maui zoning enforcement program and is responsible for handling complaints and disputes about illegal land use activity including coordinating investigations, reviewing and approving violation warning letters and monitoring payment of fines.
  • Explains state and county land use regulations to subordinate personnel, violators, and complainants.
  • Plans, assigns, reviews and supervises the work of subordinate zoning inspectors engaged in the inspection of all types of commercial and residential buildings for compliance with zoning laws, ordinances, rules and regulations, buildings and outdoor signs; as well as compliance to the Conditions of Approval imposed by permits administered under the Coastal Zone Management program.
  • Supervises the enforcement activities and speaks to and confers with designers, contractors, and the general public on problems concerning the interpretation and application of codes, ordinances, decisions and orders or other matters under the Department\'s jurisdiction.
  • Renders decisions where disputes arise over the application of the ordinances or other legal requirements between inspectors, contractors, engineers, architects and the general public.
  • Reviews daily reports of subordinates for completeness or area covered, number of inspections conducted, and consistency with codes and other requirements.
  • Supervises the review of applications for building permits and accompanying maps, plans, specifications, etc., for compliance with zoning codes and outdoor sign ordinances.
  • Interprets, makes decisions, and resolves problems in cases of disputes, conflicts and/or disagreements.
  • Supervises the preparation of inspection manuals and design forms.
  • Trains subordinates and approves all personnel actions involving subordinates.
  • Oversees the interview and selection process for new employees.
  • Investigates personnel matters and makes recommendations for discipline and/or corrective measures as appropriate.
  • Evaluates employee work performance.
  • Manages and schedules work load and assignments.
  • Approves time cards and leave requests.
  • Supervises field inspections and conducts inspections with subordinate inspectors when problems of a complicated nature arise.
  • Supervises staff in the preparation of field findings and drawings.
  • Supervises the processing of coastal and zoning related permits for compliance to various department laws and policies. Keeps abreast of coastal and zoning laws, rules and regulations, participates in disseminating such information to the public.
  • May supervise the review of plans, specifications, and reports filed before the Maui County Board of Variances and Appeals as well as staff reports and recommendations for presentation before the Board.
  • May supervise the review and approval of development plans for compliance with Outdoor Sign Ordinance, Coastal Zone Management laws, applicable zoning and land use ordinances, laws, rules, regulations and the general and community plans for the County of Maui.
  • Supervises the zoning enforcement staff in reviewing plans and specifications to ascertain whether violations exist.
  • Meets with violators to explain remedial action required, possible penalties under the law, appeal rights, and procedures and policies relative to variances in land use; provides period of grace to effect required corrective action.
  • Reviews staff reports and recommendations including charts, maps, diagrams and photographs.
  • Directs zoning enforcement staff to enforce compliance, including the issuance of stop work orders.
  • Assists County Attorneys, Prosecuting Attorneys, and other governmental agencies by providing pertinent information concerning cases.
  • Attends Commission and Council meetings to answer questions when called upon.
  • Supervises the preparation of correspondence pertaining to zoning or subdivision matters.
  • Supervises the processing of zoning permits for compliance with various County Planning laws.
  • Confers with planners and consultants on questions relating to compliance with state and county land use regulations.
  • Prepares recommendations for revisions to the zoning laws and codes.
  • Performs other related duties as required.
Minimum Qualification Requirements

Training and Experience: A combination of education and experience substantially equivalent to graduation from high school and six (6) years of inspectional or investigatory work, one (1) of which shall have been supervisory experience and three (3) of which shall have been in inspectional or investigatory work in housing, building, outdoor sign, zoning or related code enforcement work.

License Requirements: Possession of a valid motor vehicle driver\'s license (equivalent to State of Hawaii Type 3).

Knowledge of: County and State laws, ordinances, rules and regulations governing land use, signage, and buildings in the County of Maui; inspectional and investigative methods and techniques; legal procedures involved in enforcing outdoor sign and zoning laws, ordinances, etc., report writing; principles and practices of supervision.

Ability to: Supervise the work of subordinates engaged in inspecting buildings, structures and sites and render decisions in conformity with building, zoning and outdoor sign laws and ordinances; educate and motivate the public to comply with the Maui County Outdoor Sign and Zoning ordinances; develop a thorough knowledge of the interpretation and enforcement of outdoor sign and zoning codes and ordinances; prepare clear and concise reports; deal tactfully and effectively with the public.

The above examination is being given on an open-competitive basis to establish an eligible list which shall be effective for not more than one year unless extended by the Director of Personnel Services.
