SALARY RANGE: $160,000

This salary range is within the Legal Supervisory Service salary schedule LX 905-1. The salary range is based on a multitude of factors including applicable rules, regulations and guidelines.

DESCRIPTION OF DUTIES: The Office of the Attorney General for the District of Columbia is seeking an experienced trial attorney for the position of Deputy Director of the Office of Consumer Protection (OCP) within the Public Advocacy Division (PAD). PAD manages the affirmative civil enforcement litigation of OAG to protect the public interest. PAD brings enforcement actions in consumer protection, civil rights, housing, elder justice, workers\xe2\x80\x99 rights, antifraud, nonprofit, and antitrust.

The largest section in PAD and among the largest sections office-wide, OCP works to protect District consumers by bringing cases against businesses that take advantage of District residents, educating consumers in the District through outreach events and consumer alerts, and receiving and investigating complaints from consumers in the District regarding potential violations of District consumer laws. OCP both investigates and brings enforcement actions of high priority to residents and participates in national and multistate actions, with subject matters covering deceptive lending, big tech, privacy, scams, addictive and unsafe products, deceptive fees, hyperlocal matters, and more. OCP also regularly proposes legislative solutions to better protect District residents and engages frequent public speaking and consumer education efforts. The Director and Deputy Director oversee the management and operation of OCP, which includes the supervision of 12 Assistant Attorneys General, two paralegals, three investigators, and a staff assistance.

MAJOR DUTIES AND RESPONSIBILITIES: The duties of the Deputy Director include, but are not limited to:

  • Establishing priorities, policies, and procedures for OCP;
  • Managing the litigation work of the Office, including directly supervising lawyers, paraprofessionals, and administrative staff in the section, overseeing all phases of litigation and other program work, providing training and professional development opportunities, and evaluating performance;
  • Leading and coordinating nationwide investigations with other Attorney General\xe2\x80\x99s offices;
  • Engaging the public on education through town hall meetings, media, and outreach materials, as well as reaching out to community and legal services groups to amplify OAG\xe2\x80\x99s work;
  • Developing legislative proposals to strengthen existing District of Columbia consumer protection laws and, where necessary, commenting and/or testifying on pending legislation affecting District consumers;
  • Assisting in the management of an extensive consumer complaint intake and mediation program;
  • Advising the Attorney General, Chief Deputy Attorney General, First Assistant Attorney General, Deputy Attorney General of PAD, and other senior members at OAG on legal and policy issues related to consumer protection and privacy; and
  • Representing the Attorney General in meetings with high government officials.
QUALIFICATIONS: The candidate must have at least seven (7) years of civil litigation experience, including significant experience supervising legal work and the day-to-day activities of attorneys and support staff. The ideal candidate will have substantial experience with litigating complex, discovery-heavy, fast-paced litigation matters. The candidate must excel in oral and written communication, project management, and legal writing and editing. The candidate must also have a creative orientation toward the law and bring innovative thinking to the ways in which OAG can expand its work to meet the needs of District residents. Ideally, the candidate should have substantive knowledge of relevant laws, policies, and practices relating to consumer protection\xe2\x80\x94a background in privacy is a plus. We also value candidates with a demonstrated commitment to the District.

ELIGIBILITY: The successful candidate must have a law degree and be an active member in good standing of the bar of any jurisdiction. If not a member of the District of Columbia Bar, the candidate must be sworn into the District of Columbia Bar within 360 days of his/her initial appointment with the Office of the Attorney General for the District of Columbia.

GENERAL SUITABILITY SCREENING: The selected candidate will be subject to a general background investigation, including reference checks.

EMPLOYMENT BENEFITS: Selectee will be eligible for health and life insurance, annual (vacation), and sick leave and will be covered under the District of Columbia government\xe2\x80\x99s retirement plan. However, if the selectee was previously employed in the District of Columbia\xe2\x80\x99s government under an appointment for which he/she was eligible for Civil Service Retirement (CSR), contributions to CSR will resume upon re-employment.

RESIDENCY PREFERENCE:

A person applying for a position in the Career Service, Education Service, Management Supervisory Service, an attorney position in the Legal Service (series 905) other than in the Senior Executive Attorney Service (SEAS), or an attorney in the Excepted Service (series 905) who is a bona fide District resident AT THE TIME OF APPLICATION for the position, may be awarded a 10-point residency preference over non-District residents\xe2\x80\x99 applications, unless the person declines the preference points. If selected, the person shall be required to present proofs of bona fide District residency and maintain such residency for 7 consecutive years from the effective date of the appointment. Failure to maintain bona fide District residency for the 7-year period will result in forfeiture of employment. If the position you accept is in the Career, Management Supervisory, or Educational Service at an annual salary of one hundred fifty thousand dollars ($150,000) or more, you must establish residency in the District of Columbia within one hundred eighty (180) days of the effective date of employment and continue to maintain residency within the District of Columbia throughout the duration of employment.
